Welcome to HYPERLANDS! By accessing or using the HYPERLANDS platform ("Platform"), you agree to abide by the following Terms and Conditions ("Terms"). Please read them carefully.
By accessing or using HYPERLANDS, you agree to be bound by these Terms and any additional terms applicable to certain services on the Platform. If you do not agree to these Terms, you must not use the Platform.
HYPERLANDS is a digital platform where artists can mint shader code in the form of non-fungible tokens ("NFTs") and collectors can purchase, collect, and trade these NFTs.
To use HYPERLANDS, you must be at least 18 years old and capable of entering into a legally binding agreement. By using the Platform, you represent and warrant that you meet these requirements.
Artists may mint shader code as NFTs on the Platform. By minting an NFT, you affirm that the work is your original creation and that you have the right to mint, distribute, and sell it on the Platform. HYPERLANDS reserves the right to curate artists and is not responsible for verifying the originality or ownership of the minted content.
Collectors may purchase, collect, and trade NFTs on the Platform. By purchasing an NFT, you acknowledge that you are not acquiring any intellectual property rights to the underlying shader code or artwork, but rather a token representing ownership of that digital asset on the blockchain.
All content on the Platform, including but not limited to text, images, and code, is the intellectual property of its respective creators. HYPERLANDS does not claim ownership of any content minted by artists but reserves the right to use it for promotional and operational purposes.
Transactions on HYPERLANDS may be subject to fees, including minting fees, platform fees, and transaction fees. By using the Platform, you agree to pay all applicable fees. All fees are non-refundable.
All sales of NFTs on the Platform are final. HYPERLANDS does not offer refunds or exchanges for NFTs once they are purchased.
Users are prohibited from using the Platform to engage in any illegal activities, including but not limited to fraud, infringement of intellectual property rights, distribution of malicious software, and the creation or dissemination of illicit content.
HYPERLANDS reserves the right to terminate or suspend your access to the Platform at any time, with or without notice, for violating these Terms or for any other reason at its sole discretion.
HYPERLANDS is provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permitted by law, HYPERLANDS disclaims all warranties and shall not be liable for any damages arising out of or in connection with the use of the Platform.
These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of laws principles.
HYPERLANDS reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes indicates your acceptance of the new Terms.
